DISCLAIMER AND LIMITATION OF LIABILITY POLICY

1. GENERAL DISCLAIMER OF WARRANTIES

1.1

The information, software, products and services provided through TASTEIUM FOODS PRIVATE LIMITED (the "Platform") are provided on an "as is" and "as available" basis, to the maximum extent permitted by Applicable Law. The Company does not warrant that the Platform will be uninterrupted, timely, secure, error-free or free from viruses or other harmful components, or that any information or content available through the Platform will always be complete, accurate or current.

2. INTERMEDIARY STATUS AND THIRD-PARTY CONTENT

2.1

To the extent that the Platform allows users to post, upload, or share content, TASTEIUM FOODS PRIVATE LIMITED functions as an "Intermediary" within the meaning of Section 2(1)(w) of the Information Technology Act, 2000. We do not proactively monitor, endorse, edit, or assume liability for any user-generated content.

We claim safe harbour protection under Section 79 of the Information Technology Act, 2000, provided we observe the mandated due diligence under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. Any reliance on user-generated content or third-party information is strictly at your own risk.

3. EXTERNAL LINKS AND SERVICES

3.1

The Platform may contain links to or integrations with third-party websites, applications, payment services or other services that are not owned or controlled by the Company. The Company is not responsible for the content, availability, privacy practices or terms of such third-party services, except to the extent otherwise required under Applicable Law.

Your use of third-party services is subject to their respective terms and policies.

4. CYBERSECURITY AND TECHNICAL GLITCHES

4.1

The Company implements reasonable technical and organisational measures appropriate to the nature of the services and applicable legal requirements to protect the Platform and information processed through it.

However, no internet-based system or method of electronic storage can be guaranteed to be completely secure. To the maximum extent permitted by Applicable Law, the Company shall not be responsible for loss or damage arising solely from unauthorised access, cyber-attacks, malware or other security incidents that occur despite the Company's reasonable security measures or arise from circumstances beyond its reasonable control.

5. LIMITATION OF MONETARY LIABILITY

5.1

To the maximum extent permitted by Applicable Law, the total aggregate liability of TASTEIUM FOODS PRIVATE LIMITED, its directors, officers, employees and agents arising out of or relating to your use of the Platform, whether in contract, tort (including negligence) or otherwise, shall not exceed the total fees actually paid by you to the Company for the relevant services during the three (3) months immediately preceding the event giving rise to the claim, or INR 1,000/-, whichever is higher.

Provided that, the foregoing limitation shall not apply to any liability which cannot lawfully be excluded or limited under Applicable Law.

6. EXCLUSION OF INDIRECT AND CONSEQUENTIAL DAMAGES

6.1

To the maximum extent permitted by Applicable Law, the Company and its affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages arising out of or relating to the use of the Platform, including loss of profits, revenue, business, goodwill, data, business interruption or costs of procuring substitute goods or services, even if the Company has been advised of the possibility of such damages.

7. STATUTORY RIGHTS

7.1

Nothing in this Policy is intended to exclude, restrict or waive any right, remedy, liability or protection that cannot lawfully be excluded, restricted or waived under Applicable Law.

In particular, where you qualify as a consumer under applicable consumer protection law, any mandatory rights and remedies available to you shall remain unaffected by this Policy.
