REFUND AND CANCELLATION POLICY

Effective Date: DD/MM/YYYY

Last Updated: DD/MM/YYYY

1. SCOPE AND APPLICABILITY

1.1

This Refund and Cancellation Policy governs the terms under which cancellations are permitted and refunds may be issued for products or services purchased through TASTEIUM FOODS PRIVATE LIMITED (the "Platform"). This Policy shall be read together with the Company's applicable Terms of Use, Terms and Conditions, End User Licence Agreement or other contractual terms, as applicable.

2. CANCELLATION BY USER

2.1

Cancellation rights may vary depending upon the nature of the product or service purchased:

  • Subscription Services: Where applicable, you may cancel a recurring subscription through the account or cancellation mechanism made available by the Company. Unless otherwise stated at the time of purchase, cancellation will prevent renewal for the subsequent billing cycle, while access to the subscribed service may continue until the end of the current paid billing period.
  • One-Time Digital Services: Where applicable, cancellation of one-time digital products, downloads or services may not be permitted after access, download or service delivery has commenced, subject to Applicable Law and any specific cancellation or refund rights communicated at the time of purchase.

3. CANCELLATION BY THE COMPANY

3.1

The Company may suspend or cancel access to a subscription or service where reasonably necessary due to a material violation of the applicable Terms of Use, EULA or Acceptable Use Policy, fraudulent or unlawful activity, payment abuse, or other conduct that materially affects the security, integrity or operation of the Platform.

Any refund arising from such suspension or cancellation shall be determined in accordance with this Policy, the applicable contractual terms and Applicable Law.

4. REFUND ELIGIBILITY

4.1

Subject to Applicable Law and the terms applicable to the relevant product or service, a refund may be available in circumstances including:

  • Duplicate Transactions: You were erroneously charged more than once for the same order due to a technical or payment processing error.
  • Unavailability of Service: The core functionality of the purchased service is materially unavailable due to a failure attributable to the Company, subject to the applicable service terms.
  • Non-Delivery or Material Failure to Provide the Purchased Product or Service: The Company fails to deliver or provide the product or service within the committed timeframe or in accordance with the material specifications agreed at the time of purchase, subject to Applicable Law.
  • Statutory or Other Applicable Rights: A refund or other remedy is required under Applicable Law or the specific terms applicable to the relevant purchase.

5. NON-REFUNDABLE SCENARIOS

5.1

Subject to Applicable Law and any specific refund rights communicated at the time of purchase, refunds may generally not be available in the following circumstances:

  • change of mind or buyer's remorse after the service has commenced;
  • inability to use the service due to inadequate hardware, incompatible software, unsupported operating systems or inadequate internet connectivity on your end;
  • partial or unused portion of a subscription period after the applicable service or subscription has commenced; or
  • purchases made through your account by a person whom you authorised or permitted to use the account.

6. REFUND PROCEDURE

6.1

Refund requests should ordinarily be submitted within the period specified for the relevant product or service or, where no such period is specified, within a reasonable period after the issue arises, subject to Applicable Law.

7. PROCESSING TIMELINES

7.1

Once a refund request is approved by our billing team, the refund will be initiated within 5 to 7 business days. The credited amount will be routed back to the original method of payment.

Please be advised that your bank, credit card issuer, or the payment gateway __________ may take an additional 3 to 10 business days to reflect the credit in your account.

The Company shall not be responsible for delays attributable solely to banks, payment gateways or other third-party financial intermediaries, subject to Applicable Law.

8. CHARGEBACKS AND DISPUTES

8.1

Where you initiate a chargeback or payment dispute, we may investigate the transaction and may request relevant information from you or the applicable payment service provider.

Where reasonably necessary to protect against fraud, misuse or duplicate recovery, the Company may temporarily restrict the relevant account or transaction pending investigation, subject to Applicable Law.

9. STATUTORY RIGHTS

9.1

Nothing in this Policy is intended to exclude, restrict or waive any right, remedy or protection available to a consumer under Applicable Law.

Where Applicable Law provides a mandatory right to cancellation, refund, replacement, compensation or any other remedy, such right shall prevail to the extent of any inconsistency with this Policy.
